1. Any purchase of our products will be governed by these terms.
2. All products are subject to availability.
3. All orders are subject to acceptance by us & may be withheld at our absolute discretion.
4. The quantity, quality and description of any specifications for the products shall be those set out in the site but you should be aware that the images appearing on the website are not always accurate. We reserve the right to correct errors and omissions in any price or other information without any liability.
5. It is your responsibility to ensure that you hold any relevant qualifications from a recognised training organisation before purchase.
6. All advice or recommendations are followed entirely at your own risk
7. Certain goods on the Site may only be sold to persons aged 18 or over. In placing an order for any such goods you represent and warrant that you are at least 18 years old. We reserve the right to refuse any order where satisfactory proof of age has not been provided.
PAYMENT
1. Payment is due on dispatch of your order. Therefore your card will not be debited until the day of despatch. All items will be shown on your statement as being debited by Sussex Scuba .
2. If items need to be credited back to your account then the full amount will be debited and then a credit processed afterwards. This may take a few days to come through.
3. All prices in our website are subject to change without prior notice to reflect any increase in the cost to us.
4. Our shop prices may be different from the internet prices.
5. We aim to protect legitimate credit card owners from fraud and therefore will report to the necessary authorities any person attempting to use a card which they are not been authorised to use.
PROPERTY
1. Property in the product shall pass to you provided your payment has cleared and/or received.
2. Sussex Scuba asserts all of its intellectual property rights in all of its promotional materials and trademarks.
WARRANTIES & LIABILITY
1. To the extent permitted by law, we shall not have any liability for the content of any websites which link into this site.
2. All products supplied conform to all relevant British and European standards.
3. All products are supplied with a full UK supplier's guarantee, the details of which are available on request.
4. If there is a defect in any of the products then we will replace the defective products free of charge or if you choose not to have a replacement you are entitled to a full refund of the price of the product (or a proportionate part of the price). Your statutory rights are unaffected.
5. We will use all our power to ensure that the Site remains available at all times. However, we cannot guarantee that the Site will operate continuously or will be error free. We therefore cannot accept any liability for any failure or non-availability of the Site.
6. We do not accept, and hereby exclude to the fullest extent permissible under law, any liability for indirect or consequential loss or damage including, but not limited to, any loss of data, profit, revenue or business however caused. Nothing in these terms and conditions shall be construed as excluding or limiting liability for death or personal injury caused by negligence or for fraud.
EXPORT
1. If goods are to be shipped or used overseas, then it is your responsibility to ensure that the product is able to be shipped to and used in your country. Also that you have the correct qualifications to purchase the items.
2. We do not offer a refund (excluding faulty items) to countries outside of the European Union.
3. Incorrectly sized items (suits and BCD's) (excludes cylinders) dispatched inside or outside the United Kingdom and inside the European Union can be swapped but customers are responsible for the cost of shipping the items back to us and then the return carriage costs, to return the goods back to the customer. If any product that is purchased is faulty we will exchange it for an identical replacement free of charge or a full refund.
4. Consignments dispatched to addresses outside of the UK may only be sent to the registered billing address as held your credit card company.
5. Due to it being a circumstance beyond our reasonable control, we do not accept any responsibility for shipment delays due to customs issues and/or for any excise duties levied on a consignment.
VAT
1. Any order made from the UK or EU will incur 17.5% VAT unless exempt e.g. BFPO or European Business.
YOUR RIGHT TO CANCEL
1. You may cancel your order and receive a refund within 7 days of receiving the goods.
A deduction may be made from the refund to cover the direct costs of collecting the goods where they have not been returned, as requested, by the consumer. To cancel or return all or part of an order you must notify immediately by telephone.

GENERAL
1. You are not entitled to assign or transfer any of your rights or obligations under this contract.
2. This contract shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.
4. Calls to Sussex Scuba regarding any terms and conditions are to be made between the hours of 9am to 5pm Mon to Sat.
DISCLAIMER
Professional training and certification from a reputable diving agency in the technique of scuba diving must be successfully carried out before use of our products featured on the website.
Use of Scuba equipment by UNCERTIFIED, or UNTRAINED PERSONS is DANGEROUS AND CAN RESULT IN SERIOUS INJURY OR DEATH.
Any equipment purchased and received from Sussex Scuba is done so on the understanding that the customer/purchaser is fully trained and in the use of the scuba equipment and holds the relevant qualifications.
Making A Purchase
Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.We accept credit card payment. If you are shopping from North America or anywhere else, place your order and your credit card company will convert the transaction to US Dollars or your own currency.
We accept Visa and Mastercard. We do not charge for any item until it is ready to ship. Backordered items are not charged until they are shipped. You may send your credit card information via phone, fax, snail mail or over the Internet.
When confirmation of order is received, this is to indicate that we have received your order. It does not indicate that a contract exists between us. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.
Shipping And Handling
Postal RatesWe currently use a number of different methods/carriers for your valuable equipment. Our system is designed to calculate the cost and display the lowest rate for the goods you have ordered, based on the weight of your order. You may be given an option to chose a faster or more secure service, and this again is based on weight. For example, if you order a snorkel the system will present a basic cost of £2.77 for first class post. At the checkout stage you will be given options to make this Recorded Delivery, or or make it Special Delivery. This is because it is a lightweight item and these services are therefore available. Should your order have several items, or one very heavy item, then the choices of despatch will be reduced. The maximum carriage you will pay is currently £6.90 and this is for Parcelforce 24, a guarenteed overnight service
General
Sussex Scuba will take every effort to get you goods to you as efficiently and effectively as possible. All orders placed before 3:00pm will be shipped on the day of ordering (subject to payment authorization and availability). Any items, which are out of stock, will be shipped as soon as your order is complete or as they become available.
There are a number of different methods of delivery available on our website. Delivery prices will vary according to the delivery address, delivery method, size, weight and value of the goods to be shipped.
To help you understand our delivery methods and rates here is some helpful information:
VAT Exempt Orders
If this applies to you, the price you will pay for the goods will automatically be adjusted to remove the VAT element. You can also avoid paying VAT if you are having your goods sent to you in the UK, but are taking the goods abroad permanently within 3 months of making the purchase. You will have to pay the VAT with your order but by following the steps outlined you can reclaim the VAT content from us. In this case you can request a VAT Reclaim form from us (just add a note requesting this at our checkout screen). We will complete the relevant parts of this form before sending it to you with your goods. You will then take the form with you and the goods when you leave the UK and you should ask customs to fill in their section of the form at the airport, ferry terminal or channel tunnel when you leave the country. When you reach your destination outside the EU, you can then send the completed form back to us and we will refund the VAT amount charged to the credit or debit card details you have filled in on the reclaim form.

This is all subject to change and we shall not be liable for delays caused by matters out of our control.
If delivery addresses do not seem correct or legitimate then we may not send the goods. If this is to happen then the item will come up as cancelled on your order.
Delivery Schedule
DELIVERY1. Due to limited availability of some of the products we sell, a particular item may be out of stock. If this causes your order to be sent in more than one shipment, Sussex Scuba reserves the right to charge for all separate shipments.
2. In stock items will generally be dispatched the same day but some out of stock products may take longer. Any delivery date will be an estimate only, although Sussex Scuba will always strive to make sure your goods are delivered in 3-4 working days. We shall not be liable for delays caused by matters out of our control.
3. Any claim based on any defect in quality or condition of the products must be notified to us within 7 days of delivery after which you will deem to have accepted the goods.
4. Risk of damage to or loss of the product shall pass to you at the point at which they are delivered.
5. We do not accept any liability for delays caused by items that are out of stock.
Back Orders
If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.Tax Charges

Returns Policy

Damaged goods:
If any product that is purchased is faulty we will exchange it for an identical replacement free of charge provided that the product is returned to us in its original packaging and the fault is notified to us. The replacement is at the discretion of the management/technician. Please note that fault during use, may require a product to be returned to the manufacturer. In either situation you must contact Sussex Scuba before returning damaged goods
Unwanted goods:
Please contact Sussex Scuba before returning any items. A full refund (minus the cost of posting the item to you) can be issued for any unused returned goods. A restocking fee of 15% will be charged for goods that were a special order or required adjustments, eg a specific boot size on a dry suit.
Exchange goods:
If any product that is purchased does not turn out to be the correct size for you then we will exchange it for the correct size provided that the product has not been used in any way and is returned to us in its original packing (if applicable) "as new". If there is a problem then contact Sussex Scuba immediately to speak to one of our team. If the item was ordered incorrectly i.e. wrong size or colour then a free exchange can be made. Postage will not be free on the return item.

When returning goods please enclose receipt, the Return's Note (with the member of staff spoken to on the phone) and all contact details (including daytime phone), credit card details and a note of why the goods are being returned. It is essential that this is filled out and attached to your original receipt when returning the item. If this is not filled in and returned then your request will not be processed.
RETURNING UNWANTED, WRONG SIZE OR FAULTY GOODS
